Terms of service

Article 1. Definitions

  • Offer: Any offer made to the consumer.
  • Consumer: The natural person who does not act in the exercise of a profession or business.
  • Buyer: The consumer who enters into an agreement with the seller.
  • Agreement: The (purchase) agreement for the sale and delivery of products purchased by the consumer from Edorement.
  • Edorement: The provider, entrepreneur, and seller of products and/or services to the consumer or buyer.
  • Cooling-off period: The period during which the consumer can exercise their right of withdrawal.
  • Day: Calendar day.
  • Entrepreneur: The natural or legal person offering products, (access to) digital content, and/or services remotely to consumers.

Article 3. Applicability

3.1 These terms and conditions apply to every offer made by Edorement and every agreement concluded between Edorement and the consumer.
3.2 Before the agreement is concluded (remotely), the text of these terms and conditions will be made available to the consumer. If this is not reasonably possible, Edorement will indicate how the consumer can view the terms and conditions, which are always published on the Edorement website, so that the consumer can easily save them on a durable data carrier.
3.3 In exceptional circumstances, these terms and conditions can be deviated from, provided this has been explicitly agreed upon in writing with Edorement.
3.4 These terms and conditions also apply to supplementary, modified, and subsequent purchases made by the consumer.

Article 4. The Offer

4.1 If an offer has a limited validity period or is subject to conditions, this will be clearly stated in the offer.
4.2 The offer includes a complete and accurate description of the offered products and/or services. The description is sufficiently detailed to enable the consumer to make a proper assessment of the offer. Edorement uses images that truthfully represent the offered products and/or services. Edorement cannot guarantee that the colors in the images exactly match the actual colors of the product. Obvious mistakes or errors in the offer do not bind Edorement.
4.3 Every offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer.
4.4 Edorement has the right to refuse an agreement with a potential buyer for a valid reason.
4.5 Delivery times and deadlines stated in the offer are indicative and do not entitle the consumer to cancel the agreement or claim compensation unless expressly agreed otherwise.
4.6 If and insofar as an offer applies, this does not automatically apply to follow-up orders or reorders. Offers are only valid for the consumer to whom they were presented.

Article 5. Conclusion of the Agreement

5.1 The agreement is concluded at the moment of acceptance by the consumer of the offer and the fulfillment of the conditions set out therein.
5.2 If the consumer has accepted the offer electronically, the entrepreneur will immediately confirm the receipt of the acceptance electronically. Until the acceptance has been confirmed by Edorement, the consumer can cancel the agreement.
5.3 If the agreement is concluded electronically, Edorement will take appropriate technical and organizational measures to secure the electronic transfer of data and will ensure a secure online environment. If the consumer can pay electronically, Edorement will take appropriate security measures.
5.4 Edorement is not bound by an offer if the consumer could reasonably have expected or should have understood that the offer contains an obvious mistake or typographical error. The consumer cannot derive any rights from this mistake or error.

Article 6. Right of Withdrawal and Cooling-off Period

6.1 The consumer has the right to exercise their right of withdrawal within the statutory period of 14 days for non-customized products.
6.2 The cooling-off period referred to in paragraph 1 starts on the day the consumer receives the product.
6.3 If withdrawal applies, the consumer must handle the products and packaging with care. The product should only be unpacked or used to the extent necessary to establish the nature, characteristics, and functioning of the product.
6.4 The cost of returning the product is borne by the consumer.
6.5 If the consumer exercises their right of withdrawal, they must inform Edorement by email within the cooling-off period (14 days) at: info@edorement.com. Edorement will inform the consumer about the further return steps.
6.6 The consumer must return the product with all supplied accessories, if reasonably possible in the original condition and packaging with the reasonable and clear instructions provided by Edorement.
6.7 Products that cannot be returned due to customization are excluded from the right of withdrawal. This is explicitly stated in the offer.
6.8 The consumer is only liable for the decrease in value of the product resulting from handling the product in a way that goes beyond what is necessary to establish its nature, characteristics, and functioning.

Article 7. Execution of the Agreement

7.1 Edorement will execute the agreement to the best of its ability and insight.
7.2 The consumer ensures that all data, which Edorement indicates as necessary or which the consumer reasonably should understand as necessary for the execution of the agreement, are provided to Edorement in a timely manner. If the necessary data for the execution of the agreement is not provided to Edorement in time, Edorement has the right to suspend the execution of the agreement.
7.3 Edorement is not liable for any damage, of any kind, resulting from Edorement relying on incorrect and/or incomplete data provided by the consumer, unless the incorrectness or incompleteness was known to Edorement.
7.4 The consumer indemnifies Edorement from any claims by third parties who suffer damage in connection with the execution of the agreement and which can be attributed to the consumer.

Article 8. Conformity and Warranty

8.1 Edorement guarantees that the products and/or services comply with the agreement, the specifications stated in the offer, the reasonable requirements of soundness and/or usability, and the applicable laws and regulations existing at the time of the conclusion of the agreement.
8.2 Edorement does not guarantee that the product is suitable for anything other than normal use.
8.3 Any defects or incorrectly delivered products must be reported to Edorement in writing within 3 days of delivery. The products must be returned in the original packaging and in new condition.
8.4 Edorement provides a 6-month warranty against discoloration of the jewelry.
8.5 The warranty does not apply if:

  • The consumer has repaired and/or altered the delivered products themselves or had them repaired and/or altered by a third party.
  • The delivered products have been exposed to abnormal conditions or have been handled carelessly and/or improperly.

Article 9. Payment

9.1 Unless otherwise specified in the agreement or supplementary conditions, the amount due must be paid immediately after the conclusion of the agreement.
9.2 The consumer is obliged to immediately notify Edorement of any inaccuracies in the provided or mentioned payment details.
9.3 If the consumer fails to meet their payment obligation on time, they are given a period of 14 days to fulfill the payment. If payment is not made within this 14-day period, statutory interest will be charged on the outstanding amount, and Edorement is entitled to charge the collection costs incurred.
9.4 Payments are securely processed through an external payment provider on Shopify.

Article 10. Delivery

10.1 Edorement exercises the utmost care in receiving and executing product orders and in evaluating requests for services.
10.2 The place of delivery is the address provided by the consumer to the entrepreneur.
10.3 If delivery is delayed or if an order cannot be or can only be partially fulfilled, the consumer will be informed within 30 days after placing the order. In such cases, the consumer has the right to cancel the agreement without any cost.
10.4 After cancellation as per the previous paragraph, Edorement will promptly refund the amount paid by the consumer.
10.5 The risk of damage and/or loss of products rests with Edorement until delivery to the consumer or a designated representative known to Edorement, unless expressly agreed otherwise.

Article 11. Retention of Title

The ownership of the delivered products only transfers to the consumer once they have paid the total amount due to the entrepreneur. The risk of the products transfers to the consumer at the moment of delivery.

Article 12. Complaints Procedure

12.1 Edorement has an adequately publicized complaints procedure and handles complaints in accordance with this procedure.
12.2 Complaints about the execution of the agreement must be fully, clearly described, and submitted to Edorement in writing within a reasonable time after the consumer has discovered the defects.
12.3 Complaints submitted to Edorement will be answered within 14 days from the date of receipt. If a complaint takes longer to process, Edorement will respond within 14 days with an acknowledgment and an indication of when the consumer can expect a more detailed response.

Article 13. Additional Provisions

13.1 Dutch law applies to the agreement between Edorement and the consumer covered by these terms and conditions.
13.2 The entrepreneur is entitled to modify these terms and conditions. Changes to these terms will only take effect after they have been published.
